PORT ANGELES — The Clallam County Prosecuting Attorney’s Office seeks a court order to remove a property owner’s septic holding tank in the Dungeness River flood plain.
The civil action filed Dec. 23 against River’s End Road property owners Jerry and Alanna Levesque and Bob Forde asks the Superior Court to not only move the above-ground septic tank, but prevent the owners from locating any septic system on the site.
“We haven’t gotten any response on the violations that have occurred out there,” said county Community Development director Bob Martin, explaining why the court action was taken.
Martin said the septic holding tank is “a matter of public health concern,” although Community Development has no evidence of leakage because it has not conducted tests.
The Levesques and Forde have unsuccessfully appealed Community Development’s notice of violation and a cease and desist order. The county hearings examiner and board of county commissioners both denied the appeals.
