Second-degree rape trial scheduled for Port Angeles man

PORT ANGELES — Prosecutors have subpoenaed witnesses for the four-day trial of a Port Angeles man accused of raping an intoxicated and unconscious woman at a house party over the summer.

Seth Lee Owens, 23, is charged with second-degree rape after witnesses told police that he carried a sleeping woman from a living room couch to a bedroom and raped her in August, court records say.

Deputy Prosecuting Attorney Michele Devlin said she is preparing for the trial, now scheduled to begin May 15. She is waiting for a lab to return the results from a DNA test, she said.

“The evidence is there. I’m just waiting for the results,” she said.

Subpoenas for witnesses and officers were filed March 2.

Witnesses told police the alleged victim had fallen asleep on a couch in the living room of the house.

Probable cause report

One of the party-goers who stopped the alleged rape took a photograph of Owens on top of the unconscious woman, according to the affidavit for probable cause.

Witnesses told police the woman did not wake up until after the alleged rape and didn’t know what was happening.

Owens was arrested in October and has been held in the Clallam County jail on $100,000 bail.

A status hearing is set for 1:30 p.m. April 21 in Clallam County Superior Court.
